Paid Data Terms and Licence

This licence covers paid access to StackScope data: the API, the feed, exports and downloads, Stackdar alerts, and the extended view of the site that comes with a subscription. It sits alongside our terms of use, which cover the public website, and our privacy policy. Where this licence and the terms of use disagree about paid data, this licence governs.

By subscribing to or using a paid StackScope service, you agree to this licence.

StackScope is operated by DATAFREAK LTD, registered in England and Wales (company no. 17328826), registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. In this licence "we" and "us" mean DATAFREAK LTD, and "you" means the business holding the subscription.

Business use only

Paid StackScope services are supplied for business use only. By subscribing, you confirm that you are acting wholly or mainly for purposes relating to your trade, business, craft or profession, and not as a consumer.

What forms part of this licence

The description of your plan shown at checkout, including its allowances and any service-specific conditions identified there, forms part of this licence. The API documentation describes the technical operation of the service and may be updated from time to time. It does not create additional warranties or commitments. General marketing material, examples and statistics do not create additional warranties or commitments.

What you may do

Subject to the rest of this licence, we grant you a non-exclusive, non-transferable, worldwide licence for the term of your subscription to:

  • query the API and retrieve data through it
  • store the data you retrieve, and use it inside your own business
  • use it to build and operate your own products and services, within the boundary set out below
  • publish aggregate figures, statistics and analysis derived from it, with attribution as described below

You may keep and continue to use data you retrieved while your subscription was active, after it ends, under the same restrictions. We do not require you to delete it. What ends is your right to retrieve more.

Using the data in your own product

You may display limited portions of the data to users as part of a product or service that adds substantial independent functionality or analysis. Your product must not allow users to extract, download, query or reconstruct all or a substantial part of the StackScope corpus, or act as a substitute for access to StackScope itself.

What you may not do

These limits protect the value of the StackScope corpus and the rights of third parties.

  • No redistribution or resale. You may not sell, sublicense, publish or otherwise supply the data itself to anyone else, in bulk or in substantial part, whether or not you charge for it. Building a product on top of the data is fine, within the boundary above. Reselling the data as data is not.
  • No rebuilding the corpus elsewhere. You may not use the API to assemble a substantially complete copy of our data for a third party, or to run a service whose main purpose is to hand our data on.
  • No model development. You may not use the data to train, fine-tune, validate, benchmark, distil or otherwise develop a machine-learning or artificial-intelligence model, including a model for scoring, classification or technology detection, without our written permission. You may pass individual results to a model at inference time as part of your own product, for example to summarise or explain a result you retrieved.
  • No circumventing limits. Do not use multiple accounts, or any other method, to exceed the quotas on your plan.
  • No removing or altering attribution where this licence requires it, and no removing or altering any watermarking present in exported files.
  • No unlawful use. Do not use the data to break the law, including data protection law and the rules on unsolicited direct marketing. The corpus records facts about websites rather than people, but you are responsible for what you do with it.

Your team

You may allow your employees and contractors to use your credentials solely on your behalf and for your permitted use of the service. You remain responsible for their use. Credentials must not be shared with another person or organisation, and you must tell us promptly if you believe they have been compromised.

Ownership

StackScope and its licensors retain all intellectual property and database rights that subsist in the service, the corpus, its structure, and our detection, scoring and classification systems. This licence gives you permission to use the data as described above; it does not transfer ownership of the data or the StackScope service to you. You retain ownership of your own products, code and original analysis.

Attribution

If you publish figures, charts or analysis derived from StackScope data, credit StackScope and link to stackscope.dev. Attribution should be reasonably visible, and where you publish online it should be a link. Private correspondence, internal reports and non-public analysis do not require attribution. You do not need to attribute data used invisibly inside your own product.

What the data is, and is not

  • A record is an observation made when we crawled a site, usually at launch time. It is not a statement about what that site runs today. Every payload carries the freshness metadata described in the API documentation, so you can see how the observation was made and how old it is.
  • Detection is automated and imperfect. We do not warrant that any particular technology attribution is correct.
  • Country and category are estimates with confidence thresholds, not declarations by the site owner.
  • We do not serve detection methods, matching rules or per-detection evidence, and nothing in this licence grants you rights to them.
  • Sites are not vetted for safety. We record what our crawler found. We do not screen the sites in the corpus for malware, phishing, fraud, scams or any other harmful content, and a site appearing in the data is not a check, an endorsement or a safety signal of any kind. Much of the corpus is the wider web rather than reviewed launches. Treat every URL as untrusted: if you fetch these sites, or show them to your own users, that assessment is yours to make.

Third-party sources

Some launches reach us through public launch directories. We license you our own analysis, not other people's listings. Data that originates from Product Hunt or PeerPush is excluded from the paid surfaces entirely, except where our own discovery pipeline independently found and crawled the same site, in which case what you receive is our own crawl and carries none of their listing data. Which platforms sit on that list can change as agreements change. Nothing in this licence grants you any right in any third party's data, and you are responsible for your own compliance if you also hold data from those sources.

Quotas, fair use and suspension

Your plan sets a monthly credit allowance and a monthly ceiling on how many distinct launches you may touch. Both are shown at checkout and in your account. Reaching an applicable limit stops further access or retrieval until the next period; we do not bill you automatically for going over.

We may suspend or terminate access, with notice where it is reasonable to give it, if you breach this licence, if your use threatens the stability of the service, or if payment fails and is not resolved. Where we suspend for a technical reason we will tell you what it was.

Payment, renewal and cancellation

Subscriptions are billed monthly in advance, in the currency shown at checkout (pounds sterling or US dollars). Subscriptions renew automatically each month until cancelled. We charge the payment method associated with your account at the start of each billing period. You may cancel through your account or by contacting us, and cancellation takes effect at the end of the current paid period.

We do not provide partial refunds merely because you cancel during a billing period. This does not affect any refund required by law. If we permanently discontinue the paid service, or terminate your subscription for reasons that are not caused by your breach, we will refund the unused portion of any prepaid period.

Prices are stated exclusive of VAT where applicable. We are not currently VAT registered, so no VAT is presently added. If VAT becomes legally payable, it will be added to future charges after notice.

If we change prices we will tell subscribers before the change takes effect, and you may cancel rather than accept it.

Availability

StackScope does not include a service-level agreement unless we agree one separately in writing. We will make reasonable efforts to keep the service available and to give notice of planned interruptions.

Changes and discontinuation

We may change this licence as the service develops. Material changes will normally take effect from your next billing period, and we will notify you by email before then. Changes required urgently for legal, security or service-integrity reasons may take effect sooner. If a change materially reduces your permitted use, you may cancel before it takes effect.

We may discontinue a paid service by giving reasonable notice. Where practicable, we will give at least 30 days' notice. If discontinuation takes effect during a prepaid period, we will refund the unused portion.

No warranty

The data is provided as is. To the fullest extent the law allows, we exclude all warranties, express or implied, including fitness for a particular purpose and accuracy. You are responsible for deciding whether the data is suitable for what you intend to do with it.

Limitation of liability

Nothing in this licence excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or anything else that cannot lawfully be excluded or limited.

Subject to that, our total aggregate liability arising out of or in connection with the paid services and this licence is limited to the fees you paid us during the twelve months immediately before the event giving rise to the claim. We are not liable for loss of profit, revenue, business, anticipated savings or goodwill; loss or corruption of data; or any indirect or consequential loss.

What survives cancellation

When your subscription ends, these continue to apply to data you already hold: the restrictions on redistribution and resale, on rebuilding the corpus, and on model development; the attribution requirement; the ownership section; and the limitation of liability.

Your data

What personal data we collect about customers and authorised users, and how we handle it, is described in our privacy policy. This may include account and contact details, billing and transaction information received from our payment processor, service configuration, usage and security logs, and correspondence with us.

Governing law

This licence is governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
